Service Specific Terms

• CitizenDeveloper 3rd Party Services:
  • 3rd Party Services are delivered on an Actual Use basis and are billable to You for any fee’s beyond the Fee Threshold at the rate agreed upon.
  • Although some quantity of 3rd Party Services may be provided by CitizenDeveloper on an In Advance basis, any usage of 3rd Party Services by You exceeding the agreed upon maximum usage detailed in the In Advance Agreement is immediately due and payable by You.
  • I agree that if my application requires additional 3rd Party Services or other demands related to 3rd Party Services not anticipated by CitizenDeveloper at the time of entering into the 3rd Party Services Agreement, CitizenDeveloper has the right in its sole discretion to withdraw that Agreement and to offer an alternative Agreement that may include a different rate. If I do not accept this change, I agree that my services can be cancelled without further liability to Me.

• Limitation of Liability
  • I understand that neither party’s aggregate liability with respect to any single incident arising out of or relating to this SKU will exceed the amount paid by me for the then current Fee Accrual Period’s (or the then current month, whichever is smaller, calculated as a one month proportion of the total amount paid for the Fee Accrual Period) 3rd Party Services payments, and that in no event will costs incurred by CitizenDeveloper to provide 3rd Party Services be refundable.
